Villaway Website : Terms and Conditions of Use

1. DEFINITIONS

“We” are Villaway (UK) Limited, whose Registered Office
address is 1 Tunstead Lane, Hoveton, Norwich, Norfolk, NR12 8QN.
“The Owner” is the owner of the property which you agree
to hire as a result of using this service.
“The Property” is the property advertised for hire as described
in the advertisements that appear on the Web-Site.
“The Web Site” is www.villaway.co.uk or such other domain
name as we may from time to time set up.

2. AGREEMENT

You agree and acknowledge that your use of the service that we provide is governed exclusively by these Terms and Conditions.

3. OUR SERVICE

We offer an internet based service whereby we allow property owners to advertise their properties for hire through the Web Site. Our role is purely that of an intermediary. We shall deal with any enquiries that you raise and liase with the Owner to see whether the Property is available for hire for the period you require and to arrange a provisional booking.

4. DISCLOSURE OF DETAILS

4.1 As part of the service, we will need to take certain personal information from you, which you authorise us to disclose to the Owner for the purposes of arranging the hire of the property.
4.2 The service that we offer is free to use by you, but is subject to the payment of a commission by the Owner at the point that the period of hire has been provisionally agreed. We are only obliged to pass on your details to the Owner once he has paid the sums due to us. We accept no liability for any losses incurred arising out of any delay in disclosing your details to the Owner where our fees have not been paid.
4.3 We shall not pass your details to any other third party. We may however from time to time send you emails regarding our service or any promotions that we are running, unless you tick the box on the enquiry form indicating that you do not wish to receive such e mails. Alternatively, you may unsubscribe if you wish not to receive such emails at the point that you receive them.

5. THE CONTRACT

5.1 Your contract will be with the Owner, who shall liase with you direct once we have passed them your personal details and enter into a formal agreement for hire. All payments are made direct to the Owner in such manner that you agree with him. For the avoidance of any doubt, you do not have a contract with us in respect of the hire of the Property.
5.2 Accordingly, nothing within the advertisement or the Web Site constitutes an offer by us to provide the services in question. The information set out only constitutes an invitation to treat, which will only become legally binding once you have agreed terms with the Owner and entered into a contract with him direct.

6. PROPERTY DESCRIPTION

6.1 As our service is internet based, we cannot and do not carry out any checks as to the accuracy of the information set out in the advertisement regarding the Property, its services and location. The Owner is solely responsible for confirming the accuracy of the advertisement and any complaints or claims that you may have in respect of the advertisement or the Property should be taken up with the Owner direct, although for the reasons set out at paragraph 8 below we would like to be informed of any complaints.
6.2 Wherever possible, the advertisement shall provide feedback from previous hirers of the property in question to assist you in your choice of Property. This information is provided by us in good faith.

7. LIABILITY

We accept no liability for any loss or damage that you may suffer arising out of the contract that you enter into with the Owner and any claims or complaints that you have should be directed to the Owner. Whilst the Owner has warranted to us that they are either the legal owner of the Property or that they have full authority to agree the period of hire, we cannot provide any guarantees that this is in fact the case and if you are in any doubt you should carry out your own checks before agreeing any contract with them. We accept no liability for any loss or damage that you may suffer because:

  1. The Property fails to meet any description applied to it in the advertisement
  2. The Property fails to meet your reasonable expectations in terms of the quality and condition of the property, its services and facilities
  3. Any cancellation of the contract by the Owner howsoever caused
  4. Any failure of the Owner to make the Property available on the agreed dates
  5. Of any other breach of the contract by the Owner
8. FEEDBACK

We are committed to maintaining high standards and ensuring that Owners are honouring their commitments to you. To assist in this, we would ask you at the end of your stay to complete our standard feedback form, which will be used for statistical purposes on the advertisement and to notify us of any complaints that you have with the Property.

9. THIRD PARTY RIGHTS

The Contracts (Rights of Third Parties) Act 1999 shall not apply to this agreement.

10. JURISDICTION

This agreement is governed by the Law of England and the parties agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
